Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Supplementary Agreement: An agreement whereby the consumer acquires products, digital content, and/or services in connection with a distance sales agreement, provided by Remium London or a third party based on an agreement between this third party and Remium London.
  • Withdrawal Period: The period during which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person who does not act for purposes related to commercial, business, craft, or professional activities.
  • Day: Calendar day.
  • Digital Content: Data produced and delivered in digital form.
  • Ongoing Agreement: An agreement aimed at regular delivery of goods, services, and/or digital content over a specified period.
  • Durable Medium: Any means, including email, that enables the consumer or business to store information addressed personally to them in a way that allows for future consultation or use for a sufficient period, and that allows unchanged reproduction of the information.
  • Right of Withdrawal: The consumer's option to withdraw from the distance sales agreement within the withdrawal period.
  • Distance Sales Agreement: An agreement between Remium London and the consumer concluded as part of an organized system for distance selling, using one or more remote communication techniques until the agreement is concluded.

Article 3 – Applicability

These general terms and conditions apply to any offer from Remium London and to any remote agreement concluded between Remium London and the consumer. The consumer will be provided with these terms before finalizing the agreement. If this is not reasonably possible, Remium London will inform the consumer how the terms can be consulted and that they will be sent free of charge upon request.

If the agreement is concluded electronically, the terms will also be provided electronically in such a way that the consumer can save them on a durable medium.

Article 4 – The Offer

Remium London offers a complete and accurate description of the products, digital content, and/or services. Obvious errors or mistakes in the offer are not binding. Images used represent the product truthfully.

Article 5 – The Agreement

An agreement is concluded when the consumer accepts the offer and meets the conditions. If the offer is accepted electronically, Remium London confirms receipt. Remium London ensures secure data transmission and may assess creditworthiness. If warranted, Remium London may refuse an order or apply conditions.

Upon delivery, Remium London provides:

  • Contact details for complaints
  • Information about the right of withdrawal or its exclusion
  • Warranty details and post-sale service
  • Conditions for cancellation if the agreement is ongoing

Article 6 – Right of Withdrawal

The consumer may withdraw from a product purchase within 14 days without providing a reason. The withdrawal period starts the day after the consumer or an assigned representative receives the product.

Article 7 – Consumer Obligations During the Withdrawal Period

The consumer must handle the product with care and only use it as needed to evaluate it. If withdrawing, the product must be returned in original condition and packaging, if reasonably possible.

Article 8 – Exercising the Right of Withdrawal

To exercise the right, the consumer must inform Remium London via an unambiguous statement (e.g., email). The model form may be used but is not required. The consumer bears the return costs unless otherwise agreed.

Article 9 – Obligations of Remium London in Case of Withdrawal

Remium London confirms receipt of the withdrawal and refunds the consumer within 14 days after receiving the product or proof of return. Refunds are made using the same payment method unless otherwise agreed.

Article 10 – Exclusions from the Right of Withdrawal

The right of withdrawal is excluded for:

  • Custom or personalized products
  • Sealed hygiene-sensitive products if opened
  • Products mixed inseparably with others after delivery
  • Sealed media/software once opened

Article 11 – Pricing

All prices include VAT. Prices will not be changed during the offer validity period, except for VAT changes.

Article 12 – Fulfillment and Additional Warranty

Remium London guarantees that its products and services meet the specifications in the offer and legal requirements. Additional warranties are provided only if explicitly stated.

Article 13 – Delivery and Performance

Remium London processes orders with care. Delivery takes place at the address provided by the consumer. Delivery times are indicative. If a delay occurs, the consumer must notify Remium London to resolve it.

Article 14 – Ongoing Agreements

If an agreement has a term longer than one year, the consumer may terminate it with one month’s notice. The agreement may be automatically renewed unless canceled.

Article 15 – Payment

The consumer must pay within the period stated in the offer. If not, they are in default. Remium London will send a payment reminder and allow 14 days to pay before proceeding with recovery measures.

Article 16 – Complaint Handling

Complaints must be submitted promptly after discovery of defects and must be described in detail. Remium London will respond within 14 days. If not resolved mutually, it becomes a dispute subject to Article 17.

Article 17 – Disputes

These terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands. EU consumers may also use the EU’s Online Dispute Resolution platform.

Article 18 – Supplementary or Deviating Provisions

Any supplementary or deviating provisions must not disadvantage the consumer and must be documented clearly or stored on a durable medium.
